Terms.

Plain-English version of the agreement we sign with every client.

01 · What you're paying for.

A custom-designed website, built and maintained by us. Hosting, SSL certificate, domain configuration, monthly content updates (within a reasonable scope; see §04), monitoring, backups, and a real human you can call when something is wrong.

02 · The 25-month term.

When you sign up, you pay your first month and we get to work that day. There is no setup fee, no deposit, and no design fee. Your first month is the only thing due at signup.

You then commit to 24 more monthly payments at the rate quoted in your agreement: 25 monthly payments in total. The amount is the same every month.

At month 26 you have two doors: (1) buy the site outright for $1,000 and take the code, design, content, and domain with you; or (2) stay on monthly hosting and maintenance at $49/month, billed month-to-month, cancel anytime with 30 days notice. We will email you in month 24 and again in month 25 to remind you.

03 · Who owns what.

You own your domain, your content, your photos, your customer data, and your brand. Always. We will transfer the domain and any client-furnished assets to you on request, in any condition, including mid-build. If you leave early, the cancellation clause in §07 applies.

We own the design system, the page templates, and any code we write. While you're a client, you have a perpetual, royalty-free license to use them on your site. If you exit via Door 1 ($1,000 buyout), the license becomes irrevocable and we hand over the source. If you exit via Door 2 (continued hosting), the license remains active as long as you're a paying client.

04 · What's in scope.

Monthly maintenance covers: text and image swaps, new pages within the existing template, new blog/news posts, hours/holiday updates, replacing photos, fixing typos, updating your services list, swapping testimonials, integrating a new booking widget if your provider gives you embed code, and SEO meta updates.

It does not cover: rebuilding a section from scratch, designing a new template, building a custom integration with a CRM or scheduling tool we haven't seen before, multilingual versions of pages, or anything that takes more than about two hours to ship. Out-of-scope work is quoted at $125/hour and approved in writing before we start.

05 · Turnaround.

Send maintenance requests via the contact form at /contact, or call the number above. We acknowledge within one business day and ship within three for routine updates. If something is broken or down, we work on it immediately, day or night.

06 · Payment and non-payment.

Your first month is due at signup. Every month after that is billed automatically. Here is exactly what happens if a payment does not clear, day by day, so there are no surprises.

Payment schedule

Monthly payments are due on the same calendar day each month, based on your initial billing date. Payments are processed automatically via the payment method on file.

Failed payment (day 0)

If a payment fails, we will retry within 24 hours and notify you by email.

Grace period (days 1 to 7)

If the payment still hasn't cleared after 7 days, we will send a final reminder email and SMS. Your website remains live during this period.

Site suspension (day 8)

If payment is not received within 8 days of the original due date, your website will be taken offline. Visitors will see a temporary 'Site Temporarily Unavailable' page. Your domain, hosting, and files remain intact. Nothing is deleted.

Reactivation (days 8 to 30)

You can reactivate at any time within 30 days by clearing the past-due balance plus a $50 reactivation fee. Site goes back live within 1 business day of payment clearing.

Domain hold (day 30 and beyond)

If the account remains in non-payment status for more than 30 days, we may decline to renew the domain on your behalf at next renewal. We will give you 30 days written notice before any domain action and will assist with transfer to your own registrar account if you want to handle renewal yourself.

Account termination (day 60 and beyond)

After 60 days of non-payment, we may terminate the account. Site files and content remain available for download at your request for 90 days. Domain remains your property and we will transfer it to your registrar account on request.

What we will not do

We will not hold your domain hostage. We will not delete your content without notice. We will not charge punitive cancellation fees. We will not pursue collections unless the past-due balance exceeds $1,000.

07 · Cancelling early.

If you cancel before the 25-month term is up, you owe the lesser of: (a) the remaining months at your monthly rate, or (b) the buyout price of $1,000. We will not chase you. We will email an invoice. If you ignore it, we'll send it to collections, and that's the entire enforcement mechanism. No liens, no claims on your domain, no threats. Your domain is always yours; we'll release it within five business days of a cancel request, paid or not.

08 · What we don't do.

We don't write your email newsletters, take your phone calls for you, or run your books. Some things you can add on (Google Business Profile management, Local SEO, review generation, monthly content); those are separate line items with separate pricing, never bundled in by default. Anything we don't offer, we'll recommend someone who does.

09 · Liability.

If your site is down because of us, we credit you a pro-rated month. If you lose business because of an outage, we feel bad about it, and we credit you a pro-rated month. We are not insuring your revenue. We are not liable for indirect or consequential damages. Total liability is capped at the amount you've paid us in the trailing twelve months.

10 · Disputes.

If we have a disagreement, we talk first. Like, on the phone. If that doesn't work, we mediate. If that doesn't work, we go to court in Suffolk County, Massachusetts. We will not arbitrate, and we won't ask you to waive a jury trial.
